1. Acceptance of Terms

Welcome to JVR Hire Hub ("Platform", "Service", "we", "us", or "our"). By accessing or using our marketplace platform, you ("User", "you", or "your") agree to be bound by these Terms and Conditions and our Privacy Policy.

If you do not agree with any part of these terms, you must not use our Platform.

2. Platform Description

JVR Hire Hub is an online marketplace that connects:

• Employers: Individuals or businesses seeking to hire Virtual Assistants
• Virtual Assistants (VAs): Professionals offering virtual assistant services

We facilitate connections and provide tools for job postings, applications, payments, and reviews. We are not an employment agency and do not employ any users.

3. User Accounts

3.1 Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Be at least 18 years old
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access

3.2 Account Types

• Employer Accounts: For posting jobs and hiring VAs
• VA Accounts: For offering services and applying to jobs

3.3 Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms and Conditions
• Engage in fraudulent or illegal activities
• Provide false or misleading information
• Abuse or harass other users
• Remain inactive for extended periods

4. User Responsibilities

4.1 For Employers

Employers agree to:

• Post only legitimate job opportunities
• Provide accurate job descriptions and requirements
• Comply with all applicable labor laws
• Pay for services as agreed with VAs
• Treat VAs professionally and respectfully
• Not discriminate based on race, gender, age, religion, or other protected characteristics

4.2 For Virtual Assistants

Virtual Assistants agree to:

• Accurately represent skills and experience
• Deliver services professionally and on time
• Communicate honestly with employers
• Complete jobs as agreed
• Maintain client confidentiality
• Not misrepresent qualifications or work history

5. Payments and Fees

5.1 Platform Fees

We charge fees for certain platform features:

• Job Credits: Employers purchase credits to post jobs
• Featured Listings: Premium job or profile visibility
• Profile Boosts: Enhanced VA profile visibility
• Subscriptions: Premium membership plans
• Transaction Fees: Commission on completed hires (where applicable)

5.2 Payment Processing

Payments are processed via bank transfer (EFT) or other approved methods. Users must:

• Provide accurate payment information
• Use the unique payment reference provided
• Submit proof of payment for verification
• Allow up to 2 business days for payment approval

5.3 Refunds

Refunds are subject to our refund policy:

• Credits and features are generally non-refundable once activated
• Disputes must be reported within 14 days of purchase
• We review refund requests on a case-by-case basis

6. Intellectual Property

6.1 Platform Ownership

All content, features, and functionality of JVR Hire Hub, including but not limited to text, graphics, logos, icons, images, audio clips, software, and their compilation, are the exclusive property of JVR Jobs | South African Jobs and are protected by South African and international copyright, trademark, and other intellectual property laws.

6.2 User Content

By posting content (profiles, job listings, reviews, etc.), you:

• Retain ownership of your content
• Grant us a non-exclusive, worldwide license to display, distribute, and promote your content on the Platform
• Warrant that you have the right to post such content
• Agree that your content does not violate any third-party rights

7. Privacy and Data Protection

7.1 POPIA Compliance

We comply with the Protection of Personal Information Act (POPIA) of South Africa. Our collection, use, and disclosure of personal information is governed by our Privacy Policy.

7.2 Data We Collect

We collect and process:

• Account information (name, email, contact details)
• Profile information (skills, experience, company details)
• Usage data (interactions, preferences, activity)
• Payment information (transaction records, bank details)
• Communications (messages, reviews, support tickets)

7.3 Third-Party Services

We use third-party services for platform operation, including:

• Analytics: Google Analytics for usage insights
• Hosting: Web hosting providers for platform infrastructure
• Email: Email service providers for notifications
• Payment Processing: Banking partners for payment verification

These partners may have access to your data as necessary to perform their services. We ensure they maintain appropriate security measures.

8. Prohibited Conduct

Users must not:

• Post false, misleading, or fraudulent information
• Engage in spam, phishing, or unsolicited marketing
• Harass, abuse, or threaten other users
• Upload malicious code or viruses
• Attempt to access unauthorized areas of the Platform
• Scrape or data mine Platform content
• Circumvent payment systems or fees
• Create multiple accounts to abuse features
• Violate any applicable laws or regulations

9. Disclaimers

9.1 Platform "As Is"

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 No Employment Relationship

We do not employ users. Relationships formed through the Platform are independent contractor arrangements between Employers and VAs. We are not responsible for:

• Quality of work performed
• Payment disputes between users
• Tax obligations or labor law compliance
• Employment benefits or protections

9.3 User Verification

While we may verify certain user information, we do not guarantee the accuracy, reliability, or suitability of any user. Users are responsible for their own due diligence.

10. Limitation of Liability

To the fullest extent permitted by law, JVR Jobs | South African Jobs and its officers, directors, employees, and agents shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from user conduct or content
• Damages arising from third-party services or links
• Service interruptions or technical failures

Our total liability shall not exceed the fees paid by you to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless JVR Jobs | South African Jobs from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Your content or conduct on the Platform

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.

12.2 User Disputes

Disputes between users (Employer-VA conflicts) should be resolved directly between parties. We may provide assistance but are not obligated to mediate or resolve such disputes.

12.3 Platform Disputes

For disputes with the Platform, users agree to first attempt informal resolution by contacting us at jvrsoftware@gmail.com.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

We will notify users of significant changes via email or Platform notification.

14. Service Modifications

We reserve the right to:

• Modify, suspend, or discontinue any part of the Platform
• Change fees or introduce new charges with 30 days' notice
• Update features and functionality
• Remove content that violates these Terms

15. Termination

Either party may terminate the agreement at any time:

• By You: Close your account through account settings
• By Us: Suspend or terminate accounts for Terms violations

Upon termination:

• Your access to the Platform will cease
• Unused credits are forfeited
• Your data may be retained as required by law
• Provisions regarding liability, indemnification, and intellectual property survive termination

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and JVR Jobs | South African Jobs.

16.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

16.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
