About the Role
A well-established law firm with offices in both Cape Town and Johannesburg is seeking an experienced Foreclosure Litigation Secretary to join their team in their Sunninghill office. As a Senior Foreclosure Secretary, you will be responsible for ensuring the smooth execution of foreclosure processes, drafting legal documents, and maintaining effective communication with clients, banks, debtors, and law enforcement agencies.
Key Responsibilities
- Attend to the Foreclosures process
- Drafting of Affidavits, Summonses, Section 129 notices, Warrants, Notices of Sale, ad-hoc court applications, and all other foreclosure-related documentation
- Checking all documents coming back from court
- Following up on sheriffs regarding service of court processes
- Consulting with debtors regarding possible settlement
- Make payment arrangement for debtors for their home loan account
- Attending to have summonses issued and send to sheriffs for service
- Obtaining court dates for Rule 46(1) Application and having same sent to sheriffs for service
- Dealing with Correspondent Attorneys
- Instructions to Advocates to attend to Rule 46(1) Applications
- Drafting monthly reports to clients
- Attending to close file
- Attending to email queries and telephone queries
Requirements
- Matric is essential
- Paralegal or Legal certificate/Diploma will be beneficial, but not a necessity
- Minimum of 6-8 years experience as a Foreclosure Litigation Secretary
- Experience in Nedbank standard operating procedures within the Retail Business would be beneficial
- Must have extreme and in-depth knowledge of the foreclosure process
- Must be computer literate and able to work on multiple systems
- Experience with case lines / court online is essential
- Must be able to run a diary system efficiently, keep clients up to date, and not miss a deadline
- Strong administrative skills are required
- Must have a legal collections background
- Excellent people skills
- Ability to perform well under pressure
- Ability to adhere to strict turnaround times
- Ability to liaise with banks and debtors
- Ability to liaise with the Sheriff offices and other role players
- Strong communication skills
- Proficient in Office Word, Excel, and Outlook
